Short answer

Online casino play is legal in Poland only on the state monopoly site Total Casino run by Totalizator Sportowy; all other online casinos are illegal for operators and players. The minimum age to gamble is 18.

Legal overview

Online gambling in Poland is governed by the Gambling Act of 19 November 2009, enforced by the Ministry of Finance and the tax administration. Online casino games are a state monopoly operated by the state-owned Totalizator Sportowy, whose Total Casino site is the only legal online casino; Totalizator Sportowy also sells lottery games online. Private companies can offer online sports betting only with a permit from the Minister of Finance, and the Ministry publishes a list of entities legally offering gambling online. A licence from another country, including an EU state, does not make an operator legal in Poland.

Poland enforces the rules strictly. Under Article 15f of the Gambling Act, the Minister of Finance keeps a public register of domains used to offer gambling illegally, and access to listed domains is blocked from Poland. Under Article 15g, payment service providers may not provide payment services on listed sites. In January 2025 the Ministry told parliament that the register held nearly 48,000 domains, with 10,932 added in 2023 alone, most of them illegal gambling sites and some used only for advertising.

Players are also at risk. Taking part in foreign gambling is a fiscal offence under Article 107 of the Fiscal Penal Code, and the Gambling Act provides fines for players in illegal games, imposed by the head of the tax office. Promoting illegal gambling, including by streamers and influencers, is punishable under Article 110a of the Fiscal Penal Code. Winnings from authorised operators are tax-free up to 2,280 zloty per win, and larger wins are taxed at 10%. In January 2025 the Ministry said no work on amending the Gambling Act was under way.
