Is online gambling legal in San Marino?
Status of online casinos, the regulator, the minimum age and where to get help, with our sources and the date we checked them.
Short answer
Online casino play has no legal provider in San Marino, since online gaming cannot be authorised and no public-controlled online casino service was found. The minimum age to gamble is 18.
Legal overview
San Marino regulates games of chance through Law No. 67 of 25 July 2000, which covers games, prize contests, lotteries, lotto and betting. Article 1 of that law states that gambling it does not regulate remains prohibited in any form. Which games are admitted is set out in a delegated decree, currently Delegated Decree No. 177 of 7 December 2023, and supervision lies with the Ente di Stato dei Giochi, the State Gaming Authority created by Law No. 143 of 2006. The only stable gaming venue is run by the concessionaire Giochi del Titano SpA, and residents are allowed to play there.
Online gambling is treated differently. Article 2 of the 2023 decree states that online gaming activities cannot be authorised. The only exception allows entities under public control to offer games over the internet with a specific authorisation from the State Gaming Authority, and no such online casino service was found to be operating. Poker is limited to a capped number of authorised temporary events in qualifying hotels, and all admitted games are closed to anyone under 18.
There is therefore no legal way for residents to play online casino games with a San Marino operator, and offshore sites hold no local authorisation. Because the 2000 law prohibits gambling outside its framework in any form, using unauthorised online casinos falls outside the law. No evidence was found of website blocking or of action against individual players, and in February 2025 the Finance Secretary told parliament that a very large internet gambling offer exists beyond the state's control.
