Is online gambling legal in Tonga?
Status of online casinos, the regulator, the minimum age and where to get help, with our sources and the date we checked them.
Short answer
Online casino play is not licensed in Tonga and falls under the general prohibition on gambling, so no operator may lawfully offer it to residents. The minimum age to gamble is 18.
Legal overview
Tonga has no gambling law that creates a licensed market. The legal basis is the Criminal Offences Act of 1926, whose sections 82 and 83 the government cites as prohibiting gambling. In 1999 the Criminal Offences (Amendment) Act (No. 28 of 1999) inserted section 83A, which states that sections 82 and 83 do not apply to a game played under a licence obtained under any legislation. No statute that actually issues casino, betting or online gambling licences was found, so this exception does not in practice open a commercial market.
The government has restated the ban publicly. In January 2017 the Prime Minister's Office denied reports that a foreign company had received a casino licence, stating that gambling is prohibited in Tonga by law and that any gaming licence application would be futile; Cabinet rejected the casino element of a proposed resort project while approving its hotel components. There is no foreigners-only casino exception of the kind found in some Pacific states, and no land-based casino operates legally.
For online gambling this means there is no Tongan licence for online casino, poker or sports betting, and any website claiming one should be treated with suspicion. The statutes do not mention internet gambling specifically, and no prosecutions of individual online players were found, but the general prohibition gives residents no lawful route to play and no legal protection if an offshore site refuses to pay. No official gambling helpline or self-exclusion service was identified.
