Mauritania has no gambling licensing law and no gambling regulator. The main rule is Article 381 of the Penal Code (Ordinance No. 83-162 of 9 July 1983), in the section on offences against the rules on gaming houses and lotteries. It punishes anyone who keeps a house of games of chance open to the public, the bankers of such a house, anyone who runs a lottery not authorised by law, and the staff of these establishments, with two months to two years in prison and a fine of 5,000 to 300,000 ouguiya. Offenders can also lose certain civic rights for five to ten years, and all stakes, equipment and furnishings are confiscated.
The Penal Code targets operators, not players, and it does not mention online gambling. No authority issues licences for casinos, sports betting or online gaming, so no website can hold a Mauritanian licence. At the same time, no law expressly forbids residents from playing on foreign-licensed websites, and no blocking of gambling sites or payments has been reported. Online casino play therefore takes place on offshore sites in an unregulated grey area, without any local consumer protection or complaints body, and the reach of Article 381 to online operators has not been tested.
No operator can be licensed in Mauritania, and the law does not expressly bar residents from foreign online casinos, so online play is an unregulated grey area pending a draft ban.
No online casino is licensed or supervised in Mauritania, so players have no local authority to turn to in a dispute. Follow the draft gambling law, which would prohibit electronic betting once adopted.
