São Tomé and Príncipe controls gambling mainly through its Penal Code, approved by Law No. 6/2012. Article 275, headed illegal gaming, punishes anyone who, without legal authorisation, founds, opens, finances, runs or otherwise controls an establishment, casino or organisation for the profitable operation of games of chance, betting, lotteries, roulette, lotto or bingo, with one to five years in prison. When the offence is committed on behalf of a company, the company itself is criminally liable and faces a fine of 10 million to 100 million dobras. The rule targets organisers rather than players, and gambling with an authorised operator is lawful.
Authorisation exists for land-based gaming. Secondary sources report that casinos were legalised in 2004 to support tourism, with oversight by the minister responsible for tourism, and the Penal Code refers to a national lottery. No government licensing scheme for online casinos, online sports betting or online poker was found, and a January 2026 industry report states that there are no local licences for online betting or casino platforms.
Online casino play is neither licensed nor expressly prohibited for players, so residents use offshore sites in an unregulated grey market.
Treat any claim of a São Tomé and Príncipe online gambling licence with caution, as no official online licensing scheme was found. Disputes with a foreign site must go to that site's own regulator, and only operator-level limits and self-exclusion tools are available.
