New Zealand is moving from an unlicensed offshore market to a licensed online casino regime. Under the Gambling Act 2003, online casino games could not be offered from within the country, and the only legal remote gambling came from the state-owned TAB and Lotto NZ. Offshore casino sites were never licensed locally, but New Zealanders were not committing an offence by using them, and operators that declared revenue paid an online casino duty of 12%, due to rise to 16% from 1 January 2027.
The Online Casino Gambling Act 2026 passed its third reading on 23 April 2026 and came into force on 1 May 2026. It provides for up to fifteen licences, each covering a single brand, with no more than three per entity, for an initial term of up to three years that can be renewed for five more. The Department of Internal Affairs ran the licence auction from 29 September to 12 October 2026: 32 bidders took part, the price settled at NZ$15 million per licence and eleven entities won the right to apply. Applications opened in October 2026, winning the auction does not guarantee a licence, and the DIA expects the licensed regime to be fully operational in 2027.
No online casino licence had been granted as of October 2026; existing offshore providers that have applied may continue during the transition, and players are not penalised for using them.
Treat brands that have recently started targeting New Zealand with caution, because new entrants are not allowed during the transition. Once licences are issued, check the DIA public register of approved brands before you deposit.
