Legal situation in Republic of the Congo
The Republic of the Congo has a modern gambling law. Law No. 37-2024 of 11 October 2024, published in the Official Journal of 12 December 2024, regulates games of chance and money. Law No. 1-2025 of 29 March 2025 created a regulator for them, the ARJHA. The 2024 law sets four categories. Category I covers sports betting (land-based and online), casinos and online virtual games, and is open to operators that hold an approval (agrément). Category II covers horse-race betting, lotteries and scratch games, land-based and online. It is a public monopoly of the national company, in which private investors may hold up to 49%. Categories III and IV cover land-based casinos, virtual games and slot machines.
To hold an approval, an operator must be a public limited company with at least 10% State ownership and a fully paid capital of at least 2 billion FCFA. Online operators need a separate approval for each type of game. They must keep their data in Congo for three years and turn away anyone on the list of banned players. Games may not be offered to minors. The ARJHA, supervised by the minister in charge of gambling, gives its opinion on approvals, monitors online gambling and can impose financial penalties.
Online casino games are legal only from operators that hold a Congolese Category I approval. Unlicensed sites are illegal and can be blocked.
Check that a site holds a Congolese approval for the specific game type it offers, because online approvals are issued per game. Operators must exclude players on the official banned list, which also covers people who have asked to be excluded.
